1. Who we are and how these Terms apply
Forged Growth provides marketing services and software support for home-service businesses in Canada and the United States. “We,” “us,” and “our” mean Forged Growth; “you” means a website visitor or customer, as the context requires.
These Terms govern use of our website and apply to a service order only when that order incorporates them. By using the website, you agree to its use terms to the extent permitted by applicable law. If you act for a business, you must have authority to make commitments on its behalf.
Our website is for information and inquiries. You cannot complete a purchase or book an appointment directly on this website. Sending an inquiry, opening chat, or requesting a trial does not create a paid subscription or authorize a charge. We confirm service enrollment and appointments separately.
A written service order or agreement will identify the services you accept and the applicable commercial terms. Specific terms in that agreement take priority over these general Terms where they conflict, subject to mandatory law. Acceptance of these Terms is not consent to marketing emails or text messages.
2. Our services
Depending on your written order, services may include websites and funnels, customer relationship management, lead follow-up, messaging, scheduling tools, reputation management, and related marketing support. We use GoHighLevel and may use other service providers to deliver agreed services.
Website descriptions illustrate available capabilities. Your written order confirms included features, deliverables, responsibilities, support, timing, and exclusions. A feature mentioned on the website is not automatically included in every service.
3. Trials, fees and enrollment
We offer a seven-day trial. Before you enroll, we will confirm its start and end, included features, any payment details required, and what happens when the trial ends.
The advertised subscription price is CAD $297 per month. Before paid enrollment, your written order will confirm included services, applicable taxes, additional or usage-based charges, total charges, when billing begins, and any renewal arrangement. Any optional service or separate charge must be disclosed before you agree to it. We will not treat an inquiry or acceptance of these website Terms as authorization for paid enrollment or automatic renewal.
Your written order identifies the currency and total charges. Review it before agreeing to paid services. Agreed changes to fees or service terms will be communicated in accordance with your agreement and applicable law.
4. Cancellation and refunds
You may cancel future subscription renewals at any time by contacting us below. A cancellation request received before a renewal stops that renewal and subsequent renewals. We will confirm receipt, when cancellation takes effect, and when access ends. Your written order will explain the billing schedule and access during an already paid period.
Cancellation of future renewals does not itself determine whether an earlier payment is refundable. Refund requests are reviewed case by case, considering your written agreement, the circumstances and services provided, and applicable law.

5. Your responsibilities
Provide accurate information and keep contact details current. If you receive account access, protect credentials, restrict access to authorized users, and notify us promptly of suspected misuse.
You must have the necessary rights and permissions for content, images, contact lists, and other information you supply. Do not send passwords, payment-card details, government identification, health information, or other sensitive information through public website chat.
When using our services to communicate with customers, follow applicable laws and platform requirements, obtain required permissions, maintain appropriate consent records, and honor opt-outs. A publicly available phone number or email address does not by itself authorize unrelated promotional messages. Review content, campaign settings, and automated messages before use. Tell us promptly about errors or problems affecting services.
6. Acceptable use and restrictions
Do not use the website or services for spam, fraud, impersonation, misleading marketing, infringement, harassment, or other unlawful activity. Do not upload malicious software, attempt unauthorized access, disrupt services, or bypass security or messaging restrictions.
We may restrict affected access or activity where reasonably necessary to address misuse, nonpayment under an agreed order, security problems, or legal or provider requirements. Where reasonably practicable, we will notify you of the reason and steps needed to resolve the issue. Resulting billing or refund questions remain subject to your agreement and applicable law.
7. Intellectual property
Rights in our branding, website materials, software, templates, and third-party materials remain with their respective owners. You may view and use website materials for their intended purpose; these Terms do not transfer ownership or grant permission to commercially reproduce someone else's protected work.
You retain your rights in materials you provide. You authorize us to use them as reasonably necessary to perform requested services. Ownership, permitted use, and delivery of custom work will be addressed in your written service agreement. Third-party software and assets may carry their own license terms.
8. Privacy and third-party services
Our Privacy Policy explains how we handle personal information. Our Cookie Policy explains website technologies and available choices.
Third-party services, including GoHighLevel, support some functions. Their availability and features may change. A third-party link is provided for convenience and does not make us responsible for that provider's separate website. This does not remove our responsibilities for personal information or services we control.
9. SMS messaging terms
Program and message types. If you choose to receive texts from Forged Growth, messages may include inquiry replies, appointment confirmations or reminders, and promotions about our services, according to the particular consent you provide. Some messages may use automated technology.
Your choice. Website SMS opt-in is offered through our chat widget at goforgedgrowth.com. Read the disclosure and affirmatively select the relevant option. Opening chat, providing a phone number, sending an inquiry, or accepting these Terms does not by itself subscribe you to promotional texts. Promotional consent is optional and not a condition of purchase. We send promotions only with the required consent.
Frequency and charges. Message frequency varies with your inquiries, appointments, and the program you opt into. Message and data rates may apply. Your wireless provider can explain your plan's charges.
Opt out. Reply STOP to unsubscribe from our text program at any time. You may receive one confirmation message. You may also contact us below to withdraw consent. We honor other valid withdrawal requests as required by law. Texting STOP does not itself cancel a separate paid service; contact us if you also want to cancel that service.

Phone numbers and delivery. Provide a number you are authorized to use and tell us if it changes. Carriers are not liable for delayed or undelivered messages. Delivery depends on networks and devices; this program is not an emergency service.
Privacy. Our Privacy Policy describes mobile information and SMS consent handling. No mobile information will be shared with third parties or affiliates for marketing/promotional purposes.
10. Service information, results and warranties
We aim to keep website information accurate, but information can change or contain errors. Confirm material details in your written order.
Marketing outcomes depend on your market, offer, advertising, implementation, follow-up, and other factors. We do not promise a particular number of leads, appointments, sales, rankings, or revenue. We cannot guarantee uninterrupted access or delivery of every message.
These statements do not override an express written service commitment or exclude any warranty, service standard, or remedy that applicable law does not allow us to exclude.
11. Liability
To the extent permitted by law, neither party is responsible under these Terms for losses that were not reasonably foreseeable when the relevant agreement was made. Each party must take reasonable steps to reduce a loss after becoming aware of a problem.
Nothing excludes or limits liability for fraud, intentional misconduct, gross negligence, or liability that cannot lawfully be excluded or limited. Additional service-specific limitations must be stated in your written agreement and remain subject to applicable law.
12. Governing law and your legal rights
These Terms are governed by Ontario law and the federal laws of Canada applicable in Ontario. Mandatory protections that apply to your transaction or jurisdiction remain unaffected.
Nothing requires you to waive a non-waivable consumer protection, cancellation right, warranty, refund right, or legal remedy. We do not require arbitration or a waiver of class proceedings through these website Terms. If a provision is unenforceable, the remaining provisions apply to the extent lawful.
13. Changes to these Terms
We may update website Terms by posting a revised version and effective date. Changes apply prospectively. Changes to existing paid services are governed by your written agreement and applicable notice or consent requirements; a website update does not silently replace those commitments.
